BV Maths Terms and Conditions (Parents/Students)

Definitions
1.1 In these Terms and Conditions:
a) "Account" refers to the secure account created by You upon registration, where Your personal information is stored and from which You can access BV Maths Services via Your BV Maths Login.
b) "BV Maths/We/Us" refers to Ben Vince trading as ‘BV Maths’, a sole trader.
c) "BV Maths Services" refers to the provision of tutoring services via the Site.
d) "Site" refers to www.bvmaths.com and any associated websites or platforms operated by BV Maths.
e) "Student" refers to the student receiving tutoring services through BV Maths.
f) "Tutor Content" refers to any content uploaded, embedded, or displayed on the Site by a Tutor, including text, images, videos, and lesson plans.
g) "Tutoring Services" refers to the provision of online tutoring by a Tutor to You or Your child via the Site.
h) "You/Your" refers to the parent or guardian booking tutoring services on behalf of the Student.

Acceptance of Terms
2.1 By creating an account and booking tutoring services, You agree to these Terms and Conditions. These Terms are effective immediately upon acceptance.
2.2 You acknowledge that BV Maths may modify these Terms from time to time. If any significant changes occur, You will be notified via email and given 30 days to accept the new Terms. If You disagree with the changes, You may terminate your account.

Booking Tutoring Services
3.1 You may book tutoring sessions for Your child through the Site. Each booking is subject to availability and confirmation by BV Maths.
3.2 You are responsible for ensuring that all information provided about the Student is accurate and up-to-date.
3.3 You are responsible for selecting the appropriate tutor for the Student, although BV Maths may offer recommendations.
3.4 You are responsible for ensuring the Student is present and prepared for each tutoring session, including having access to the required Equipment, such as a computer, internet connection, and webcam.

Duties and Responsibilities of Clients
4.1 You agree to ensure that the Student attends scheduled tutoring sessions and is in a suitable learning environment.
4.2 You agree to provide feedback to BV Maths about the tutoring sessions as needed.
4.3 You are responsible for paying for the tutoring sessions as outlined in Clause 5.
4.4 You must notify BV Maths if the Student is unable to attend a scheduled session, providing as much notice as possible (preferably at least 24 hours).
4.5 You agree to act in accordance with BV Maths' safeguarding policies and notify BV Maths of any concerns regarding the Student's welfare or safety.
4.6 You must ensure that the Student behaves appropriately during tutoring sessions. In the event of misconduct by the Student, BV Maths reserves the right to suspend or terminate the services immediately, and You may be held responsible for any resulting consequences.

Fees and Payment
5.1 All tutoring services are subject to the fees listed on the BV Maths Site at the time of booking. Fees may vary depending on the Tutor’s qualifications and experience.
5.2 Payments for tutoring services are due in advance and can be made through the Site.
5.3 BV Maths reserves the right to adjust the fees for services, with prior notice to You.
5.4 You acknowledge that payments made for tutoring services are non-refundable except in cases where BV Maths is unable to provide the tutoring session due to Tutor unavailability or technical failure.
5.5 In the case of missed or cancelled sessions, You agree to provide at least 24 hours’ notice. Failure to do so may result in a charge for the session.
5.6 In case of technical issues, BV Maths will work with You to resolve them or offer an alternative, such as rescheduling the session. If the issue is not resolved, You may be entitled to a partial refund, subject to BV Maths' discretion.

Cancellation and Rescheduling
6.1 You may cancel or reschedule a tutoring session at least 24 hours before the scheduled time. Cancellations made with less than 24 hours’ notice may incur a charge equivalent to the full session fee.
6.2 BV Maths reserves the right to cancel or reschedule a session if the Tutor becomes unavailable or there are technical difficulties. In such cases, You will be notified as soon as possible, and a replacement session will be arranged.
6.3 If You are dissatisfied with a session for any reason, You should notify BV Maths within 24 hours of the session, and we will investigate the matter.

Confidentiality and Data Protection
7.1 BV Maths and its Tutors are committed to protecting the privacy of Students. All personal data provided by You will be handled in accordance with applicable data protection laws, including the General Data Protection Regulation (GDPR) and the UK Data Protection Act 2018.
7.2 You agree to provide accurate and up-to-date personal information about the Student, including any relevant health or learning needs.
7.3 You agree that BV Maths may collect and process personal data related to the Student for the purpose of providing tutoring services, including storing session records and feedback.
7.4 You may request access to the Student’s personal data held by BV Maths by submitting a request to support@bvmaths.com. We will comply with any reasonable request, subject to the provisions of the GDPR.
7.5 BV Maths will retain personal data related to the Student for a period of up to 2 years after the final session, unless you request its deletion sooner.

Intellectual Property
8.1 All content created by the Tutor during tutoring sessions (including lesson plans, worksheets, and videos) remains the intellectual property of BV Maths or the Tutor.
8.2 By booking a session, You agree to grant BV Maths a non-exclusive, royalty-free, perpetual licence to use, store, and distribute Tutor Content for the purposes of quality assurance, safeguarding, and client access to lesson recordings.
8.3 You agree not to use Tutor Content for any commercial purposes without prior written consent from the Tutor.
8.4 You must not upload or use copyrighted material in the tutoring sessions unless You or the Tutor have the legal right to do so.
8.5 BV Maths reserves the right to remove any content that breaches copyright laws or infringes third-party intellectual property rights.

Limitation of Liability
9.1 BV Maths will take reasonable steps to ensure the quality of the tutoring services provided, but we cannot guarantee academic success or specific outcomes.
9.2 BV Maths is not liable for any indirect, special, or consequential loss or damage arising from the tutoring services provided, including the Student’s progress or lack thereof.
9.3 BV Maths is not responsible for any technical issues, such as internet connectivity problems, which may affect the delivery of tutoring services. However, we will work with You to resolve such issues or offer a suitable alternative arrangement.

Termination of Services
10.1 You may terminate the provision of tutoring services at any time by disconnecting from your Tutor.
10.2 BV Maths reserves the right to suspend or terminate tutoring services if You or the Student fail to meet the obligations set out in these Terms and Conditions, including non-payment, misconduct, or failure to comply with safeguarding policies.

Changes to Terms and Conditions
11.1 BV Maths may update these Terms and Conditions from time to time. Any significant changes will be communicated to You via the email address provided in Your Account.
11.2 You may terminate your Account at any time if You disagree with the revised Terms. By continuing to use the Site after such changes, You are deemed to accept the new Terms.

Governing Law
12.1 These Terms and Conditions are governed by the laws of England and Wales.
12.2 Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Mediation and Dispute Resolution
13.1 If a dispute arises between You and BV Maths, You agree to attempt to resolve the dispute through informal means.
13.2 If informal resolution is unsuccessful, the dispute will be referred to mediation, before taking any legal action.

 

 

 

BV+ Subscription Terms and Conditions (Parents/Students)

These BV+ Subscription Terms (“BV+ Terms”) apply to your purchase and use of BV+, a subscription-based digital service provided by Ben Vince trading as “BV Maths”, a sole trader (“BV Maths”, “we”, “us”, “our”).

 

These BV+ Terms apply in addition to the BV Maths Terms and Conditions (Parents/Students). Where there is any conflict, these BV+ Terms take precedence in relation to BV+ only.

 

1. Definitions

 

1.1 In these BV+ Terms:

 

a) “Account” means your BV Maths account used to access BV+.

b) “BV+” means the BV+ subscription service, including all digital tools, features and content made available as part of the subscription.

c) “BV+ Content” means all digital content, tools, questions, AI outputs, analytics, trackers, generators, and materials made available through BV+.

d) “Subscription” means your recurring paid access to BV+.

e) “Subscription Period” means the billing interval (monthly or otherwise) selected at checkout.

f) “Student” means the student for whom BV+ is being used.

g) “You / Your” means the parent or legal guardian purchasing or activating BV+.

 

2. Scope of BV+ Services

 

2.1 BV+ is a digital educational support platform. It may include, but is not limited to:

 

- AI-powered chat or study assistance

- Exam or practice paper generation

- Homework banks and question sets

- Progress tracking and analytics

- Learning insights and study tools

 

2.2 BV+ does not include live tutoring unless expressly stated at the point of purchase.

 

2.3 BV+ provides educational support tools only. It does not replace teacher instruction, live tutoring, or professional educational advice.

 

3. Eligibility and Account Use

 

3.1 You must be at least 18 years old and legally able to enter into contracts to purchase BV+.

 

3.2 You confirm that you have authority to allow the Student to use BV+.

 

3.3 BV+ access is granted per household / per student unless otherwise stated. You must not share login details with third parties.

 

3.4 You are responsible for all activity carried out under your Account.

 

4. Subscription, Billing and Payment

 

4.1 BV+ is provided on a recurring subscription basis, billed in advance for each Subscription Period.

 

4.2 Payments are processed via our payment provider (e.g. Stripe). BV Maths does not store full card details.

 

4.3 Your Subscription will automatically renew at the end of each Subscription Period unless cancelled before renewal.

 

4.4 You authorise us to take recurring payments until you cancel your Subscription.

 

4.5 Subscription prices may change. Where this affects you, we will give reasonable advance notice before renewal.

 

5. Free Trials and Promotions 

 

5.1 From time to time, BV Maths may offer free trials or promotional access to BV+.

 

5.2 Unless cancelled before the end of the trial period, your Subscription will automatically convert to a paid Subscription.

 

5.3 Only one free trial is permitted per household unless stated otherwise.

 

6. Cancellation and Cooling-Off Rights

 

6.1 You may cancel your BV+ Subscription at any time via your Account or by contacting support@bvmaths.com. Cancellation takes effect at the end of the current Subscription Period.

 

6.2 Cooling-off period:

In line with UK consumer law, you have 14 days from initial purchase to cancel your Subscription.

 

6.3 Where you request immediate access to BV+ digital content, you acknowledge that:

 

Access may begin immediately; and

You may lose your right to a full refund once BV+ content has been accessed or used.

 

6.4 After the cooling-off period, subscription fees are non-refundable, except where required by law.

 

7. Fair Usage and Acceptable Use

 

7.1 BV+ is provided for personal, non-commercial educational use only.

 

7.2 You must not:

 

- Share access outside your household

- Scrape, download, or redistribute BV+ Content

- Attempt to reverse engineer or bypass system limits

- Use BV+ in a way that disrupts or overloads the platform

 

7.3 We reserve the right to apply fair usage limits to protect platform performance and integrity.

 

7.4 Abuse or misuse of BV+ may result in suspension or termination without refund.

 

8. AI Tools and Accuracy Disclaimer

 

8.1 BV+ may include AI-powered tools that generate explanations, questions, feedback, or suggestions.

 

8.2 While we take reasonable steps to maintain quality, AI-generated outputs may be incomplete, simplified, or incorrect.

 

8.3 You acknowledge that:

 

-BV+ does not guarantee correctness, grades, or exam outcomes

-AI outputs should be reviewed and supported by independent learning and/or human instruction

-BV Maths is not responsible for decisions made based solely on AI-generated content

 

9. Intellectual Property

 

9.1 All BV+ Content, including software, question banks, AI prompts, templates, analytics, and branding, is the intellectual property of BV Maths or its licensors.

 

9.2 You are granted a limited, non-exclusive, non-transferable licence to access BV+ Content for personal educational use during an active Subscription.

 

9.3 You must not copy, distribute, sell, sublicense, or commercially exploit BV+ Content.

 

10. Data Protection and AI Processing

 

10.1 BV Maths processes personal data in accordance with UK GDPR and the Data Protection Act 2018.

 

10.2 Student data may be used to:

 

-Personalise learning tools

-Track progress and usage

-Improve platform performance

 

10.3 Further details are set out in our Privacy Policy.

 

11. Suspension and Termination

 

11.1 We may suspend or terminate your access to BV+ where:

 

-These BV+ Terms are breached

-There is misuse, fraud, or abusive behaviour

-Required payments fail

 

11.2 Where possible, we will notify you before suspension or termination.

 

11.3 Termination of BV+ does not affect any outstanding payment obligations.

 

12. Limitation of Liability

 

12.1 Nothing in these BV+ Terms limits liability for fraud, or death or personal injury caused by negligence.

 

12.2 Subject to clause 12.1, BV Maths is not liable for:

 

-Loss of academic results or grades

-Reliance on AI-generated content

-Indirect or consequential losses

 

12.3 Our total liability in connection with BV+ shall not exceed the subscription fees paid by you in the 12 months preceding the claim.

 

13. Changes to BV+ and These Terms

 

13.1 We may update BV+ features or functionality from time to time.

 

13.2 We may update these BV+ Terms. Where changes are material, we will notify you in advance.

 

13.3 Continued use of BV+ after changes take effect constitutes acceptance.

 

14. Governing Law and Disputes

 

14.1 These BV+ Terms are governed by the laws of England and Wales.

 

14.2 Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

 

BV Maths — Tutor Subscription Terms and Conditions

1. Who we are

1.1. These terms and conditions (“Terms”) apply to your use of the BV Maths platform as a tutor.

1.2. The platform is operated by Ben Vince trading as “BV Maths”, a sole trader in England and Wales (“BV Maths”, “we”, “us”, “our”).

1.3. Address: 24 Vaudrey Drive, Hazel Grove, Stockport, SK7 5PB. Contact: benvince@bvmaths.com.

1.4. These Terms form a binding agreement between BV Maths and you, the tutor (“Tutor”, “you”, “your”).

2. Eligibility and account

2.1. You must be 18 or over and legally able to enter contracts.

2.2. You are responsible for the accuracy of your profile and for securing your login. All account activity is deemed authorised by you.

2.3. We may conduct identity and compliance checks (including KYC) and may suspend or refuse activation at our discretion.

3. Commission, pricing and payment obligations

3.1. BV Maths charges an 18% commission on all lesson fees collected from students introduced, referred or booked via the BV Maths platform.

3.2. The commission is deducted automatically before funds are paid out to you.

3.3. You must set and maintain accurate lesson prices in your tutor dashboard.

3.4. Commission applies to every lesson taught to any BV-Introduced Student (see Clause 9), regardless of where the lesson takes place (online/offline).

3.5. BV Maths may update the commission rate or fee structure with 14 days’ notice. Continued use of the platform constitutes acceptance.

4. What BV Maths provides (scope of service)

4.1. A profile/listing on bvmaths.com and tools to receive enquiries and bookings.

4.2. Access to BV Maths’ homework bank and progress tracker.

4.3. An admin hub for lesson notes and student management.

4.4. Platform provided “as is” with no guaranteed uptime.

4.5. We may modify features as reasonably required.

5. What BV Maths does not provide

5.1. We do not supervise, monitor or deliver your lessons.

5.2. We do not guarantee bookings, earnings or results.

5.3. We do not create bespoke lesson plans for tutors.

6. Tutor status, DBS, safeguarding and conduct

6.1. You are an independent contractor. You are not an employee or agent of BV Maths.

6.2. You are responsible for your taxes and for maintaining appropriate insurance.

6.3. DBS requirements remain your responsibility.

6.4. You must comply with safeguarding law and our Safeguarding & Conduct Policy.

6.5. If you record sessions, you must obtain informed consent.

6.6. You are responsible for your own conduct and lesson content.

7. Student enquiries, bookings and messages

7.1. You must respond to enquiries promptly.

7.2. Communications must be professional and accurate.

7.3. You must not make misleading claims about qualifications or outcomes.

8. Payments, refunds and withdrawals

8.1. You appoint BV Maths as your payment collection agent.

8.2. Refunds/chargebacks may be deducted from your payouts.

8.3. Payout timing varies based on bank networks and anti-fraud checks.

8.4. We may use set-off for any sums owed by you (e.g., refunds, fees, damages).

8.5. You are the supplier of tuition services; BV Maths may issue receipts administratively.

9. Non-circumvention — BV-Introduced Students

9.1. Definition: A “BV-Introduced Student” is any student/parent who:

a) contacted you via BV Maths;

b) was referred to you by BV Maths;

c) was acquired through BV Maths advertising;

d) was matched to you through our systems;

e) discovered you through the platform or any BV Maths campaign.

9.2. Commission obligation:

You must pay 18% commission on all lessons taught to any BV-Introduced Student, whether taught via the platform, privately, in-person, online or by any other means.

9.3. Prohibition on taking BV students off-platform:

You must not attempt to bypass or avoid paying commission by:

a) moving a BV-Introduced Student off-platform,

b) soliciting direct payments from them,

c) teaching them privately without BV Maths involvement,

d) asking them to contact you directly instead of booking through BV Maths.

9.4. Pre-existing clients excluded:

This clause does not apply to students you taught before joining BV Maths and can provide reasonable evidence for.

9.5. Breach and liquidated damages:

If you take, teach, solicit, or accept payment from a BV-Introduced Student outside the BV Maths system without paying commission, you agree to pay liquidated damages of £150 per student, which represents a genuine pre-estimate of BV Maths’ financial loss, operational cost, and loss of business opportunity.

9.6. Additional rights:

BV Maths reserves the right to:

a) suspend or terminate your account immediately;

b) pursue recovery of unpaid commission;

c) seek injunctive relief to prevent further breach.

9.7. Evidence:

We may rely on enquiry logs, communications, payment records, screenshots, marketing touchpoints, or any relevant data to demonstrate that a student was BV-Introduced.

10. Homework bank and platform content

10.1. Licence to use in-platform only: We grant you a limited, revocable, non-transferable licence to assign items from the homework bank to your students inside the platform.
10.2. No export: You must not copy, scrape, download, bulk export, share or reuse the homework bank or any question content outside the platform.
10.3. We may apply technical limits and auditing to protect fair use and our intellectual property.

11. Your content and intellectual property

11.1. Your materials: You retain intellectual property rights in lesson notes, resources and content you upload (“Tutor Materials”). You grant BV Maths a royalty-free, worldwide licence to host, reproduce and display Tutor Materials for the purpose of operating the platform and your tutor services.
11.2. BV Maths IP: All platform software, branding, templates, question bank content and analytics are the intellectual property of BV Maths or its licensors. No rights are granted other than those expressly stated.
11.3. You will not reverse engineer, decompile, scrape, or create derivative works of the platform or the homework bank.

12. Reviews, testimonials and marketing use

12.1. We may display reviews about you and may moderate or remove content that breaches these Terms.
12.2. You grant us permission to use your name, profile, and anonymised results in platform listings and BV Maths marketing. You may opt out by written notice.

13. Acceptable use

You agree not to:
a) Misrepresent your identity, credentials or results;
b) Post unlawful, defamatory, discriminatory or harmful content;
c) Solicit BV-Introduced Students off-platform during the non-circumvention period;
d) Interfere with the platform, introduce malware or attempt unauthorised access;
e) Scrape, harvest or copy platform content or user data.

14. Data protection (summary)

14.1. Laws: Each party will comply with the UK GDPR and Data Protection Act 2018.
14.2. Roles:

  • For enquiries and leads generated via the site, BV Maths is a controller.
  • For student records you create/manage in the platform (e.g., lesson notes, progress), BV Maths acts as your processor.
    14.3. The Data Processing Addendum in Schedule 1 applies when BV Maths processes personal data on your behalf.
    14.4. You must only enter student data that you are lawfully permitted to process, and you must provide all required privacy information to your students/parents.
    14.5. Security: You must keep your account secure and use strong passwords; you must notify us promptly of any suspected breach.
    14.6. Export on exit: On request within 30 days of cancellation we will provide a reasonable export of your student contact and progress data that you created, excluding the homework bank and third-party materials.

15. Complaints, disputes and risk management

15.1. We operate a complaints channel for parents and tutors. You will cooperate with reasonable requests for information and will respond promptly to complaints involving you.
15.2. We may temporarily hold payouts or suspend your account while we investigate complaints, safeguarding concerns or suspected breach.

16. Suspension and termination

16.1. We may suspend, restrict or terminate your account where: (a) you breach these Terms; (b) there is risk to users; (c) you fail verification or required checks; (d) non-payment.
16.2. You may cancel any time in your account.
16.3. Clauses that by nature survive termination shall survive, including non-circumvention, IP, confidentiality, data protection and liability.

17. Warranties and indemnities

17.1. You warrant that: (a) you are qualified and competent to provide GCSE Maths tuition; (b) your DBS is current and accurate; (c) your profile and claims are truthful; (d) you will comply with law and our policies.
17.2. Tutor indemnity: You shall indemnify and hold BV Maths harmless against claims, losses, costs and liabilities arising from or related to: (a) your lessons or advice; (b) your breach of law or these Terms; (c) your misuse of data; (d) your IP infringement; (e) your misconduct.

18. Liability

18.1. Nothing in these Terms limits or excludes liability for fraud, or death/personal injury caused by negligence, or any liability which cannot be limited under law.
18.2. Subject to 18.1, BV Maths shall not be liable for: loss of profitsloss of businessloss of dataloss of goodwill, or indirect/consequential losses.
18.3. Subject to 18.1, BV Maths’s total aggregate liability to you in any 12-month period shall be limited to the total subscription fees you paid to BV Maths in that period.

19. Force majeure

We are not liable for delay or failure caused by events beyond our reasonable control, including outages of hosting providers, payment networks, or telecoms.

20. Changes to the service and to these Terms

We may update the platform and these Terms from time to time. We will give 14 days’ notice for material changes by email or in-app. Continued use after the effective date constitutes acceptance.

21. Notices

Notices will be sent by email to the address in your account or posted in-app. You should send legal notices to benvince@bvmaths.com.

22. Assignment and subcontracting

You may not assign or transfer this agreement without our consent. We may use subcontractors (including processors) to provide the service.

23. No partnership

Nothing in these Terms creates a partnership, joint venture, agency or employment between you and us.

24. Third party rights

No person other than the parties has rights under the Contracts (Rights of Third Parties) Act 1999 to enforce these Terms.

25. Severance

If any provision is invalid, the remainder stays in force. We will replace invalid terms with valid ones closest in effect.

26. Governing law and jurisdiction

These Terms are governed by the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction.

 

 

Schedule 1 — Data Processing Addendum (UK GDPR)

A1. Subject matter and duration
BV Maths will process personal data as your processor for the purpose of providing the platform to manage your students and lessons. Processing lasts for the term of your account and a 30-day exit period for data export, after which personal data will be deleted or anonymised unless required to be retained by law.

A2. Nature and purpose
Providing hosting, storage, display, analytics, messaging, homework assignment and progress tracking functionality.

A3. Types of personal data and data subjects

  • Data subjects: students, parents/guardians, prospective students/parents.
  • Data types: names, contact details, lesson notes, homework assignments and results, progress data, booking history, communications metadata, payment references (not full card data), and any content you upload.

A4. Processor obligations
BV Maths shall:
a) Process personal data only on your documented instructions (these Terms and in-app settings);
b) Ensure staff confidentiality;
c) Implement appropriate technical and organisational security measures;
d) Assist you in responding to data subject requests;
e) Notify you without undue delay after becoming aware of a personal data breach;
f) Provide reasonable information to demonstrate compliance and allow audits on reasonable notice (no more than annually) without disrupting service;
g) Delete or return personal data after the end of services, subject to legal retention;
h) Maintain records of processing as required by law.

A5. Sub-processors
You grant general authorisation for BV Maths to appoint sub-processors (e.g., hosting, cloud, analytics, payment service providers). We will maintain a list available on request and will provide advance notice of changes where feasible. We shall impose data protection obligations on sub-processors equivalent to this Addendum.

A6. International transfers
Where personal data is transferred outside the UK, BV Maths will ensure appropriate safeguards, such as the UK Addendum to the EU Standard Contractual Clauses, or other lawful transfer mechanisms.

A7. Your obligations
You will obtain all necessary consents/notices from students/parents, ensure data entered is accurate and proportionate, and configure your settings and access controls responsibly.

 

Schedule 2 — Safeguarding & Conduct

1) Purpose and Scope

  • Protect children and young people who receive tuition via BV Maths.
  • Set expected standards of conduct for tutors using the platform.
  • Clarify BV Maths’ role as platform operator and the responsibilities of independent tutors.
  • Applies to: all tutors with active BV Maths profiles, and BV Maths staff/contractors who handle enquiries and data.

2) Principles and Legal Framework (UK)

  • We align to Working Together to Safeguard Children (2018, updated 2023) and the spirit of Keeping Children Safe in Education (KCSIE) where relevant to online tuition.
  • Relevant legislation includes the Children Act 1989/2004, Safeguarding Vulnerable Groups Act 2006, Care Act 2014 (vulnerable adults), Equality Act 2010, Protection of Children Act 1978 (images), UK GDPR/Data Protection Act 2018.
  • We operate on the principles of: welfare paramountcy, proportionality, confidentiality with appropriate information-sharing, and early help.

3) Definitions

  • Child/young person: under 18.
  • Parent: includes legal guardians/carers.
  • DSL: Designated Safeguarding Lead for BV Maths (Ben Vince).
  • Tutor: independent contractor using BV Maths to advertise/manage tuition.
  • Allegation: any claim or concern that a child has been harmed or is at risk of harm by a tutor or another adult involved in tuition.

4) Roles & Responsibilities

  • BV Maths (Platform Operator):
    • Verify a valid Enhanced DBS before activating a tutor account.
    • Maintain a complaints/reporting route and record-keeping.
    • Act on concerns: suspend access, escalate to authorities where appropriate, cooperate with investigations.
    • Provide policy access, updates, and basic guidance.
  • Designated Safeguarding Lead (DSL):

    • Receive/triage concerns, decide on escalation, liaise with statutory agencies, maintain a secure incident log.
  • Tutors (Independent Contractors):
    • Maintain a current Enhanced DBS and provide it on request.
    • Follow this policy and any updates.
    • Deliver safe, professional online tuition.
    • Report safeguarding concerns immediately using the procedure below.
    • Keep accurate lesson notes sufficient to evidence delivery and any safeguarding observations.

5) Safer Recruitment & Vetting (Tutors)

  • Mandatory before activation:
    • Enhanced DBS certificate sent to benvince@bvmaths.com for verification.
    • ID check (name matches DBS).
    • Declaration that the tutor has read and will comply with this Policy.
  • Ongoing:
    • Annual self-declaration of continued suitability.
    • Refresh DBS every 3 years or sooner if circumstances change (recommended).
    • Immediate disclosure to BV Maths of any arrests/charges/convictions or safeguarding investigations.

6) Code of Conduct (Tutors)

  • Professional boundaries:
    • Keep communication professional, lesson-focused, and transparent. No flirting, sexualised language, or comments about appearance.
    • Do not share personal phone numbers or private social accounts with students. Use platforms or agreed professional channels with parental oversight.
    • Do not meet students in person unless expressly agreed in writing with parents and compliant with safeguarding law.
  • Online behaviour & environment:
    • Dress appropriately; use a neutral background; ensure no inappropriate items or other children are visible.
    • No alcohol, vaping, drugs, or offensive materials in view.
    • Ensure a parent/guardian knows when sessions occur and how to reach you.
  • Physical contact: Not applicable to online tuition; never request or encourage physical demonstrations that could be unsafe or invasive.
  • Gifts & favouritism: Avoid giving/receiving personal gifts. Treat all students fairly.
  • Social media & images:
    • Do not connect with students on personal accounts.
    • Do not take screenshots, photos, or videos of students. See Recording policy (Section 8).
  • Academic integrity:
    • Never complete assignments or exams on behalf of a student.
    • Be honest about qualifications and results; no misleading claims.

7) Lesson Safety Standards (Online)

  • Confirm the student’s identity and that a parent/guardian is aware of the session.
  • Start/end on time; keep a simple lesson note including date/time, topics covered, homework set, any concerns observed.
  • Use reputable video tools. Keep chat logs and materials professional.
  • Maintain up-to-date antivirus and apply device security updates.
  • If a student appears in distress or discloses harm, follow the reporting procedure immediately.

8) Recording & Photography

  • BV Maths does not routinely record sessions.
  • Tutors must not record lessons or capture images unless there is explicit written consent from the parent/guardian and a clear educational purpose.
  • If a recording is agreed: tell all participants at the start, store securely, restrict access, and delete per retention rules.
  • Never share recordings or images on social media or marketing without explicit written consent.

9) Recognising Abuse & Indicators

Abuse can be physical, emotional, sexual, neglect, and can occur online (e.g., grooming, harassment, bullying, exposure to harmful content). Indicators include unexplained injuries, drastic behaviour change, sexualised behaviour/language, persistent tiredness/hunger, frequent absences, fearfulness, or concerning online interactions.

10) Reporting a Concern – What Tutors Must Do

If a child may be at risk of harm, do not delay.

  1. Immediate danger? Call 999.
  2. Otherwise:
    • Make brief, factual notes (who/what/when/where) using the Incident Report Form (Appendix A).
    • Email the DSL immediately: benvince@bvmaths.com with subject “Safeguarding Concern – [Tutor Name]”.
    • If you cannot reach the DSL promptly, contact NSPCC 0808 800 5000 or the child’s Local Authority Children’s Social Care and then inform the DSL.
  3. Do not promise confidentiality to the child. Explain you may need to share information to keep them safe.
  4. Preserve any relevant evidence (chat logs, emails) securely.

11) Responding to a Disclosure (Tutor Guidance)

  • Stay calm, listen, avoid leading questions.
  • Reassure appropriately: “Thank you for telling me. You’ve done the right thing.”
  • Do not investigate. Record facts, not opinions.
  • Report immediately as per Section 10.

12) Managing Allegations Against Tutors

  • Immediate measures: BV Maths may suspend the tutor’s platform access and hold payouts while concerns are assessed.
  • Escalation: The DSL will consider referral to Children’s Social Care and/or Police. In England, LADO consultation may be appropriate where an individual working with children is alleged to have harmed or may pose a risk.
  • Cooperation: Tutors must cooperate with any investigation and provide requested information.
  • Outcomes: May include reinstatement, conditions, training, formal warning, or permanent removal from the platform. Where appropriate, BV Maths may share information with other platforms or authorities under lawful bases to protect children.

13) Information Sharing & Confidentiality

  • Share only what is necessary to protect the child and in line with UK GDPR.
  • Safeguarding concerns are a recognised lawful basis for sharing with statutory agencies.
  • Keep records accurate, factual, and promptly submitted to the DSL.

14) Data Protection & Record-Keeping

  • BV Maths keeps a secure incident log with restricted access.
  • Retention: safeguarding records normally kept for a minimum of 6 years from case closure unless advised otherwise by authorities.
  • Data is processed per BV Maths Privacy Policy and the Data Processing Addendum in tutor T&Cs.

15) Whistleblowing

  • Concerns about BV Maths processes or another tutor can be raised to benvince@bvmaths.com.
  • If you believe a concern is not being acted upon, contact NSPCC Whistleblowing Advice Line 0800 028 0285.

16) Training & Guidance

  • Tutors should complete basic safeguarding and online-safety training and refresh every 2 years.
  • BV Maths will provide access to this policy and periodic reminders/guidance.

Tutors should complete at least one of the following free online modules within the last 24 months and refresh regularly. These do not replace an Enhanced DBS, and some clients may ask for paid, accredited safeguarding certificates.

17) Policy Breaches & Sanctions

  • Breaches may result in warnings, suspension, account removal, notification to parents/authorities, and retention of evidence.
  • Material breaches may also trigger consequences under the Tutor T&Cs (e.g., non-payment, liquidated damages where applicable).

Schedule 3 — Refunds, disputes and chargebacks (summary)

  1. Parent/student refunds: BV Maths may issue refunds consistent with consumer law where services are not delivered or materially mis-described.
  2. Tutor disputes: We will notify you of disputes and invite your response. We may temporarily withhold payouts while a dispute is assessed.
  3. Chargebacks: If a chargeback is raised, we will provide evidence to the payment network. Chargeback amounts and fees may be deducted from your payouts.
  4. Evidence: Keep clear records of lessons delivered, communications, and homework assigned/progress to support dispute resolution.
